The following Terms and Conditions apply to all bookings made on this website and via WhatsApp. This is our common policy for our rental units, if there are different policies per unit or property owner, please check the booking description of each unit. We kindly ask that you take a moment to read them prior to making a booking.

PLEASE REVIEW THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. BY USING, VIEWING, OR OTHERWISE UTILIZING THIS SITE, THE SERVICES OR FUNCTIONS OFFERED IN OR BY THIS SITE AND/ OR THE CONTENTS OF THIS SITE IN ANY WAY, YOU AGREE TO EACH AND ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE IMMEDIATELY DISCONTINUE USE OF AND LEAVE THIS SITE. IF YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER OR ARE OTHERWISE INCAPABLE OF ENTERING INTO A LEGALLY BINDING AGREEMENT, PLEASE IMMEDIATELY DISCONTINUE USE OF AND LEAVE THIS SITE.

Kaystay may, at any time, in its sole discretion, modify, add, or remove all or portions of these terms and conditions without prior notice and, unless otherwise indicated, such changes will be effective immediately; therefore, please refer to these terms periodically for changes. Your continued use of this site following any changes to these terms and conditions shall be deemed acceptance of any such changes. 
 

1. Definitions
The purpose of these Terms and Conditions is to prescribe the rights and obligations between KLP JSC. (hereinafter referred to as “the Company”, “we”, “us”, or “Kaystay”) and the Guest (one who wishes to reserve accommodation on this site or via Whatsapp and one who actually stays at this our properties; hereinafter shall mean the same) (hereinafter referred to as “you”, “yours”).
“Booking” means the booking for accommodation, functions and/or any other services or items made with us.
“Service” refers to the service provided by Kaystay as described in the relative terms (if available) and on this platform.
“Terms” means these terms and conditions.
“Contract” means the Booking and these Terms, and any other terms and conditions stated to apply to the Booking.
“Websites” means www.kaystay.com or any other website owned or operated by us.
“Third-party service” means advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you. 


2. Reservation Process
Step 1: Find a property and select room(s).
Step 2: Select, where applicable, one or more supplementary services.
Step 3: Fill out a guest information form.
Step 4: Check the reservation details, total price, and applicable terms and conditions, and make any necessary changes to the selection (guest information, number of guests, total price, date, room type), before proceeding to the next step.
Step 5: Select payment method.
Step 6: Carefully view and accept the terms and conditions before confirming the booking.
Step 7: Booking confirmation to be sent to guests's WhatsApp and/ or email.
 

3. Booking Confirmation
Upon completing payment, a booking confirmation email will be sent to your registered email and/ or a written confirmation from our Customer Support team via WhatsApp and/ or SMS (only applicable for Vietnamese phone numbers: +84).
 

4. Restrictions
You agree not to, and will not permit others to: 

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the platform or make available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of this platform. 
  • Perform any acts that infringe or risk infringing on the copyrights, trademarks, or other intellectual property rights, privacy rights, personal rights, or any other rights of other guests, third parties, the company.
     

5. Check In & Check Out
Our check in/ checkout time:

  • Check in time is at 02:00PM
  • Checkout time is at 12:00PM
  • Early check in is subject to room availability.
  • Late checkout can be requested subject to availability and will be charged at an hourly rate at the discretion of Kaystay.

6. Payment
We currently accept Bank Transfer and Online Payment.
 

7. Cancellation Policy and No Shows

  • Reservations with prepayment cannot be changed and/or canceled in any way, and sums paid in advance as a deposit cannot be refunded. 
  • Changes to reservations can be made directly with Kaystay, for inquiries, kindly contact us at booking@kaystay.com.
  • In case the guest does not check in at the accommodation after 10:00PM on the day of arrival without contacting Kaystay, the booking may be deemed to have been terminated by the guest and no refund will be made.
  • If the stay is terminated early by the guest, the full agreed price will be paid. In the case of a reservation with prepayment, no refund will be made.
  • Bookings are personal and can in no case be transferred to a third party, whether free, at a cost, or for commercial purposes.

8. Damage
Guests will be charged for any loss or damage to the properties caused by yourself, your pet, your visitors, or for any person for whom you are responsible.
 

9. Personal Information
All personal information stored and used by us is done so in accordance with our Privacy Policy.
 

10. Force Majeure
In cases of force majeure (which means any objective circumstances that are unforeseen and unavoidable, including but not limited to strikes, civil disturbances, war, fire , floods, other emergencies, or any delay in making necessary and essential repairs by Kaystay,...) that make it impossible for the guest to perform the said obligations, we will not be responsible for any losses, damages, costs, claims... beyond our control.
 

11. Limitation of Liability
Except where prohibited by law, in no event shall Kaystay be liable for any special, indirect, or consequential damages or any damages whatsoever, including loss of profits or data, whether in an action in contract or tort, arising out of the use or performance of this site or the content, or the performance or non-performance by us or any third-party providers of products or services related to this site. This limitation of liability shall apply regardless of whether the claim asserted is based on contract, negligence, or any other theory of recovery, even if we have been advised of the possibility of such damages.
 

12. Governing Law
These terms and conditions, and the respective rights and obligations of the company and the guest, shall be governed by, and construed in accordance with, the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles.


13. Changes 
Kaystay reserves the right to add, modify, delete, or otherwise change any of these terms and conditions of use or of the offerings, products, and programs described within this site at its sole discretion at any time and without prior notice. Kindly visit the site regularly for changes. Guests’ continued use and/ or access to this site means that the guests have agreed to each and all of the terms, conditions, and notices in this site without modification.


14. Promotions
The site may, from time to time, contain sweepstakes and other contests and promotions that require guests to send material or information about themselves. Those sweepstakes, contests, or promotions may be governed by a separate set of rules that may have eligibility requirements. It is the guests' responsibility to read such rules to determine whether your participation, registration, and/ or entry are valid. Guests must agree to read and comply with such rules before entering any sweepstakes, contest, or promotion on this site.


15. Web Site Information
While all reasonable efforts have been taken to ensure the accuracy of the information on this site, we do not accept responsibility for errors or omissions and reserve the right to amend, cancel, or vary any of the arrangements featured on the site without notice. Please note that in certain circumstances, generic photographic images have been used to represent the general style of a particular accommodation.
The content on this site is the copyright of Kaystay, and may not be copied, reproduced, published, distributed, or amended for any other purpose without our prior written consent.
